By accessing or using TutorboardAI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

TutorboardAI provides an AI-powered platform for generating educational whiteboard diagrams. The Service includes:

  • AI-generated diagram creation from text prompts
  • Storage and management of created diagrams
  • Multiple export formats (PNG, PDF, SVG based on subscription tier)
  • Subscription plans and one-time credit purchases

3. User Accounts

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account
  • Not share your account with others

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you must have parental or guardian consent.

4. Subscription Plans and Payments

We offer both subscription plans and one-time credit purchases:

  • Subscriptions: Monthly recurring billing. Starter plan ($8.99/month) and Pro plan ($23.99/month)
  • Credit Packs: One-time purchases that never expire
  • You can cancel subscriptions at any time
  • Refunds are provided on a case-by-case basis within 7 days of purchase
  • Unused subscription credits do not roll over to the next billing period
  • One-time credit purchases never expire

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights of others
  • Generate harmful, offensive, or inappropriate content
  • Attempt to reverse engineer or compromise the Service
  • Use automated tools to access the Service without authorization
  • Resell or redistribute generated diagrams commercially without proper rights
  • Abuse or overload our systems

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

Your Content: You retain ownership of the text prompts you provide. By using the Service, you grant us a license to process your prompts to generate diagrams.

Generated Diagrams: You own the diagrams generated from your prompts, subject to our terms. You may use them for personal, educational, or commercial purposes.

Our Service: The Service, including its design, functionality, and underlying technology, is owned by TutorboardAI and protected by intellectual property laws.

7. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee:

  • Uninterrupted or error-free operation
  • Accuracy or completeness of generated content
  • That the Service will meet your specific requirements

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

8. Cancellation and Termination

Your Rights: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

Our Rights: We may suspend or terminate your account if you violate these Terms or engage in fraudulent activity. Upon termination, your access to the Service will cease, but you may export your data before termination.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or through the Service. Your continued use after such changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration.
